Why is it considered necessary to register Agreement for Sale?

Because it guarantees legal security for both the buyer and the seller, ensures the validity of the transaction before third parties, and allows proper registration in the Public Property Registry.

What documents do I need to provide when selling a house?

Identification documents, title deed, proof of no debts, tax status certificate, among others (see full list in the sale file).

How can I benefit from capital gains tax exemptions?

You can benefit if:

  • You prove you lived in the property.

  • You haven’t sold another property in the last 3 years or haven’t claimed an exemption previously.

  • You show invoices for improvements or related property expenses.

What are the tax obligations of each party in a real estate transaction?

Seller:

  • Income tax (ISR)

  • Cedular tax (if applicable)

  • Up-to-date service payments: property tax, water, condo fees, CAPA, public works fees

  • Realtor commission

  • Certificate of no liens

Buyer:

  • Appraisal

  • Notary and registration fees

  • Mortgage-related expenses

  • Property acquisition tax

Note: ISR does not apply in all states. VAT applies to commercial properties.
